Abstract

This paper examined the adjudication and implementation of local content policies in Nigeria, adopting a doctrinal methodology. The paper investigated the legal framework, institutional arrangements, and judicial decisions related to local content adjudication, with a focus on the challenges and gaps in implementation. The paper revealed that despite the existence of a robust legal framework, local content adjudication and implementation in Nigeria are plagued by several challenges, including: inadequate institutional capacity and resources, lack of clarity and consistency in judicial decisions, insufficient stakeholder engagement and participation, corruption and abuse of discretion by regulatory officials. Based on the findings, this paper recommended that the Nigerian Content Development and Monitoring Board (NCDMB) and other regulatory agencies should be strengthened to enhance their capacity to implement local content policies. The judiciary should provide clear and consistent guidance on local content adjudication to avoid confusion and uncertainty. Stakeholders, including indigenous companies and communities, should be engaged and participatory in the implementation of local content policies. Corruption and abuse of discretion by regulatory officials should be addressed through robust accountability mechanisms and sanctions. In conclusion, this paper demonstrated the need for a comprehensive overhaul of local content adjudication and implementation in Nigeria. Addressing the challenges and gaps identified in this study is critical to promoting indigenous participation, enhancing economic development, and ensuring the effective implementation of local content policies.
